By using the WorshipSpot.com web site (the "Site"), you agree to the following terms of use (the "Terms of Use"). This Site is owned and operated by ESPER MEDIA, LLC (hereafter, "ESPER MEDIA").
Usage
The downloadable content contained on this Site is licensed for a single member to use within their respective company or organization and is non-transferable. Anything you download from this Site, including but not limited to, files, images, and data (collectively, the "Content") is licensed to you by ESPER MEDIA and may not be redistributed or sold. ESPER MEDIA retains all intellectual property rights. Downloading Content does not transfer title to you.
All Content, including the design and layout of the Site, is protected by United States and International copyright laws. It is illegal to duplicate, download or distribute any Content from this Site except for your use. In addition, all Content is subject to the following usage terms:
You may use our Content for:
- Church services
- Presentations
- Web pages
- Publications
- Advertising and promotional materials
- Broadcasts
- Products (including those intended for sale - example: Worship CD cover art)
- to compete with us. While it is permissible to incorporate our Content in a product you intend to sell, you cannot give away or resell the Content itself (example: as part of a clip-art or photo collection)
- as part of an electronic template or application (example: web page designs intended for resale)
- as a service mark or trademark
All subscribers (Yearly and FREE accounts) are automatically added to the WorshipSpot.com email list to receive product updates, special offers and policy change information. WorshipSpot.com is committed to maintaining an opt-in list and provides an easy unsubscribe link in every email list communication. You can remove yourself from our mailing list at any time.
Refund Policy
If you purchased a subscription: A full refund will be issued upon request within three (3) days of your invoice date, provided that you have not downloaded more than five (5) Content items. After three (3) days, or download of more than five (5) Content items, no cancellations will be accepted, no refunds made and you will be responsible for and must pay the full amount. By requesting a refund, you are confirming that: (i) you have not, and will not use any Content from the subscription, and (ii) you have deleted or destroyed all downloaded Content. A breach of the foregoing shall require you to immediately repay the entire subscription fee plus damages to ESPER MEDIA. If you purchased individual files: ESPER MEDIA does not currently offer refunds for individual file purchases.
Copyright Concerns
If you believe that Content on this Site has been wrongfully used, please contact us at info@WorshipSpot.com or call (480) 206-3369. Please provide us with as much information as possible to aid us in investigating your complaint.
Limited Liability
You expressly acknowledge and agree that ESPER MEDIA accepts no liability for damages of any kind whether incidental, indirect or consequential, in connection with your use of, or inability to use, this Site.
Warranties
ESPER MEDIA expressly disclaims any and all warranties of any kind, whether express or implied, including but not limited to the implied warranties of accuracy, correctness, reliability, merchantability, fitness for a particular purpose and non-infringement.
ESPER MEDIA does not warrant that the content or functions contained in the Site will be free from errors, interruptions, omissions, or defects. The Site is delivered "as is".
Indemnification
You agree to indemnify and hold ESPER MEDIA, its parents, subsidiaries, affiliates, officers, agents, vendors, licensors and any other partners and employees harmless from any and all losses, expenses, damages or costs, including reasonable attorneys' fees, resulting from any violation of the terms of use, your use of the worshipspot.com service, and the conduct of others accessing content.
Product Availability
Products and services offered on this Site may not be available in your country. Reference to any product or service does not imply that ESPER MEDIA intends to make available such products or services in your country.

These Terms of Use shall be governed by and construed in accordance with the laws of Arizona, U.S.A. These Terms of Use contain the entire agreement between you and ESPER MEDIA and govern your use of this Site. This agreement supersedes any prior agreements between you and ESPER MEDIA. The invalidity or unenforceability of any provision of these Terms of Use will not affect the validity or enforceability of any other provision of these Terms of Use. The failure of ESPER MEDIA to enforce any right or provision of this agreement does not constitute a waiver of the right or provision. You agree that ESPER MEDIA reserves the right to amend these Terms of Use at any time, for any reason, and without notice. In addition, ESPER MEDIA reserves the right to terminate this Site without notice.
